These General Terms and Conditions of use (hereinafter referred to as "the T&Cs") govern the relationship between:

Ek Takay Shikkha Foundation(এক টাকায় শিক্ষা ফাউন্ডেশন), a social welfare organization which is registered in the office of “Registrar of Joint Stock Companies and Firms” under the Societies Registration Act, 1860(Registration No- CHS-663/2021). The company’s registered office is located at Karim Manjil - First Floor, Zero Point, University of Chittagong, Vill- Zobra, P/O- Fatehpur, P/S- Hathazari, Chattogram -4331, Bangladesh, and from this location operates the website accessible at:https://ektakayshikkha.org/ [Hereinafter referred to as "Ek Takay Shikkha"] The Registered Users of the website accessible at https://ektakayshikkha.org/, and of the services which are offered online by this website, [Hereinafter referred to individually or collectively as "The Member" or "The Members"]

Preface

Ek Takay Shikkha operates a website dedicated to humanitarian, sustainable development, and social impact, which is accessible at https://ektakayshikkha.org/, and whose purpose is to enable Members to provide sustainable support to disadvantaged students. This platform gives registered Members access to:

  • Live updates of their self-donation
  • Live updates of other member’s donation unanimously
  • Live updates of expenses of the donation
  • Live updates and information on various projects
  • Information and services which can facilitate support actions for selected development projects

[Hereinafter referred to as “The Site”.]

In accordance with the Terms and Conditions provided in Article 1 below, the Member acknowledges that he/she meets the conditions for membership as defined in Article 1.1 below, that he/she has read these Terms and Conditions and agrees to comply with them without reservation.

[The Terms and Conditions are referred to hereafter as "the T&Cs" or "the Contract”.]

The T&Cs can be complemented by specific conditions or additional contractual agreements, which may become part of this Agreement. The Personal Data Protection Policy, annexed to these T&Cs and to which the Member undertakes to respect in the same way as the provisions outlined by the T&Cs, is also incorporated into the Contract. These T&Cs, as well as documents relating to the protection of personal data and related services, are hereinafter referred to, together or separately, as "the Contractual Documents".

Registered and unregistered, both types of members can donate on the platform and see their donations on the donation dashboard. All Donors are also Members and thereby accept, at the time of registration, these T&Cs.

Herein, “Payment Service Providers" or "PSPs" are the companies, approved by the Bangladesh Bank, that have been mandated by Ek Takay Shikkha for financial transfers relating to donations.

Article 1 - Registration
  • 1.1 Conditions for acquiring membership
  • Those who are interested to donate at least 30tk monthly, are eligible to be a member or user. Members will retain their membership as long as they retain their capacity to abide by the conditions of the Contract. In addition, the acquisition of Membership status is subject to the absence of any prohibition to use the Site in the Member’s country of residence. Given the nature and purpose of the Site, the Member undertakes to use the Site only for non-professional and, in any case, for nonprofit activities. This condition is essential and decisive for the conclusion and performance of this Agreement. To become a Member, the user must have read these T&Cs and the attached Personal Data Protection Policy and must have unreservedly accepted them. The Member will not be charged any fees at the time of registration.

  • 1.2 Registration procedure and creation of a Member account
  • In order to be able to use all the site’s features, the Member must first complete the registration form. The Member guarantees to Ek Takay Shikkha that he/she has provided accurate, complete, and up-to-date information about himself/herself. In particular, the Member undertakes to provide a valid and functional phone number and email address. The Member undertakes to regularly update all his/her personal information. Each Member may at any time make changes to his/her personal information by identifying himself/herself on his/her account. "Ek Takay Shikkha" is entitled to suspend the account of a Member who registered in violation of this contract, in particular, if he/she provides false, inaccurate, outdated or incomplete data or if "Ek Takay Shikkha" is informed of any action deemed as misconduct. When registering on the Site, the Member confirms that he/she has read these T&Cs as well as the Personal Data Protection Policy and agrees to comply with them at all times.

  • 1.3 Member account and identifiers
  • The Member undertakes to create only one account. The Member further agrees never to use the account, name, or username of a third party. During the registration process, the Member communicates, in addition to his/her email address, his/her last name, first name, country of residence, and date of birth (information also referred to as "Login") as well as a chosen password. When registering, the Member may choose a preferred language, and a username and provide a profile picture.

    Any profile photograph provided by the Member must not:

    • Represent any form of nudity.
    • Be a photograph of a third party.
    • Represent the logo or trademark of an organization for which it is not the legal representative as a donor company or to which it does not belong, knowing that "Ek Takay Shikkha" reserves the right to accept or decline the use of a logo and to set conditions for its use.
    • Disseminate provocative opinions about an institution, party, political or trade union movement or religious community or any other community or, more generally, with the purpose of creating unrest within the political, trade union, or religious communities or any other community.

    The Login and password chosen by the Member are confidential. The Member undertakes to never disclose his/her identifier to a third party. He/She is solely responsible for the confidentiality of these identifiers as well as for the use that could be made of his/her account by a third party who has logged into his/her account with or without authorization. "Ek Takay Shikkha" shall in no event be liable for any loss or damage resulting from a breach of this confidentiality obligation. The Member undertakes to inform "Ek Takay Shikkha" immediately of any unauthorized use of his/her account.

    "Ek Takay Shikkha" reserves the right to deactivate the Member's account after a period of total inactivity of three (3) months or more. In the event of deactivation, the Member will have the possibility to reactivate his/her account within thirty (30) days of the suspension. A Member's account may not be deactivated if the Member is known, moreover, to be an active Donor, in particular in the event of a commitment by the Donor to a regular donation.

    In the event of the Member's death, and upon production of a death notice, the account is deactivated. Its content may only be transmitted to the rightful claimants by a court decision.

  • 1.4 Conditions of access to the Site - adequate computer tools
  • The Member acknowledges that he/she has the necessary skills and resources to access and use the Site. To this end, the Member acknowledges having verified that the configuration of the tool at his/her disposal to access the Site is adequate and that it is in good working conditions.

    Article 2 - Donations
  • 2.1 Conditions for acquiring and maintaining donor status
  • All the registered/unregistered members who can donate are termed as Donors. He/She shall retain the membership as long as he/she retains his/her capacity to abide by the conditions of the Contract.

  • 2.2 Confidentiality of donations
  • Following a direct donation, the first 4digit of the transaction ID and the first 4digit of the Registered Mobile Number will appear on the page of the donation. This be associated with the Member's profile in order to be able to follow its evolution on his/her Profile. The total amount of the donation will not be publicly disclosed.

  • 2.3 Allocation of donated funds/ Expenses
  • The funds collected are allocated to projects supporting disadvantaged students, disadvantaged educational institutions, and the education of the people of disadvantaged localities according to the decision of the executive committee of “Ek Takay Shikkha”. “Ek Takay Shikkha” can use donation for responding to any national emergency issues.

    Article 4 - Confidentiality and personal data

    The personal data of a member will be protected by “EK Takay Shikkha” and will not be used in any commercial activities.

    Article 5 - Intellectual property

    “Ek Takay Shikkha” is the owner of all software, technical, graphic, textual, and other elements of the Site, with the partial exception of the Content provided by the Members themselves and by the Partners. In particular, the Site is made available to users and Members using software created through the initiative of “Ek Takay Shikkha”, which edits, publishes, and discloses it under its management. “Ek Takay Shikkha” also owns the databases used in the operation of the Site.

    The acceptance of these T&Cs constitutes recognition by the Member of “Ek Takay Shikkha”'s intellectual property rights listed in the previous paragraph and an agreement to respect them.

    6 Site license agreement

    “Ek Takay Shikkha” grants to the Member a non-exclusive, personal and non-transferable license to use the Site, exclusively for non-professional or nonprofit use, in accordance with the site’s purpose (hereinafter referred to as "the License").

    Any professional reuse of data extracted from the Site is strictly prohibited without the explicit prior consent of “Ek Takay Shikkha”.

    Article 7 - Duration and Termination
  • 7.1 Duration of contractual relations
  • The Contract is entered into for an indefinite period of time from the moment the Member accepts these T&Cs. Each Member is eligible to register as a Donor, also for an indefinite period.

  • 7.2 Termination of the contract by “Ek Takay Shikkha”
    • 7.2.1 Termination for misconduct
    • “Ek Takay Shikkha” may automatically suspend access to the Site and to the Service in the event of a Member’s non-compliance with these T&Cs,. “Ek Takay Shikkha” then notifies the Member of this suspension by email or text or phone call, and will also notify the Member to stop the identified violation. At the end of a period of seven (7) days from the initial notification, and when no changes in the Members’ actions occur, “Ek Takay Shikkha” may terminate the Contract automatically, without formality, and without prejudice to any damages intended to compensate for the damage resulting from the breaches. This termination is not likely to give rise to any refund of sums already paid by the Member as part of donations. In general, “Ek Takay Shikkha” reserves the right to terminate the Agreement or suspend the account of a Member whose presence on the platform would likely harm and/or damage its reputation. This is the case, for example, when a User’s activity, (known by other Members) on the platform violates the fundamental principles defended by “Ek Takay Shikkha”.

  • 7.3 Data output
  • In the event of termination of the Agreement, the personal data processed by “Ek Takay Shikkha” in the course of operating the Site shall, at the Member's discretion, be deleted or returned, in a standard format.

    Article 8 - Liability
  • 8.1 Liability of the Member
  • It is the Member's responsibility to take all appropriate measures to protect his/her own data, computer systems, and/or software from contamination by possible viruses. The use of any information, messages, or data of any kind available through the Service is the sole responsibility of the Member, and the decisions or actions that the Member may take or take into consideration for such information shall not engage any liability other than that of the Member. The Member is solely responsible for his/her use of the Site and its functionalities, in particular from his/her account and profile. He/She is responsible for all data and information concerning themselves, that which he/she has put online as well as for any content that he/she has provided. This responsibility holds regardless of whether this data or Content is accessible and/or transmitted to the public via one of the communication or exchange areas of the Site or is addressed to anyone by email, or data that he/she has stored on his/her personal space within the Site. The Member agrees to comply with any measures implemented by “Ek Takay Shikkha” in accordance with applicable law.

  • 8.2 “Ek Takay Shikkha”'s responsibility
  • “Ek Takay Shikkha” undertakes to provide its services in accordance with these T&Cs. “Ek Takay Shikkha” does not verify the accuracy of the information provided by the Member(s) and Partner(s) and accepts no responsibility for the inaccuracy, inadequacy or illegality of such information. Due to the particular nature of the Internet network, access to the site may be interrupted or restricted at any time by a cause unrelated to “Ek Takay Shikkha”; in this case, “Ek Takay Shikkha” cannot be held liable. “Ek Takay Shikkha” shall also not be held liable in the event of interruption of access to the site due to maintenance operations, updates, or technical improvements, or to any changes in its content and/or presentation. In addition, “Ek Takay Shikkha” may temporarily or permanently interrupt access to the Site and Services, particularly in the event of intentional termination of the Site and Services, or in the event of judicial or amicable liquidation of the company; in the latter cases, this contract shall be terminated automatically. “Ek Takay Shikkha” has the right, at any time and without notice, to change any information on the Site as part of updating it or correcting any errors or inaccuracies. “Ek Takay Shikkha” is not responsible for the content of third-party websites, which are accessible via hypertext links. To the fullest extent permitted by law and to the extent that “Ek Takay Shikkha” would be found liable for any damages not provided for above, “Ek Takay Shikkha”'s liability shall be limited to certain, actual, and established damages. To the fullest extent permitted by law, “Ek Takay Shikkha” shall not be liable for any indirect damages, loss of profit, or damage resulting from loss of data or business interruption caused by the use or inability to use the Site.

  • Article 9 - Agreement on proof
  • The Member and “Ek Takay Shikkha” agree, by mutual agreement, that the data extracted from “Ek Takay Shikkha”'s computer systems and files shall constitute evidence between them. Consequently, the computer files and registers stored within the computer systems operated by “Ek Takay Shikkha” or on its behalf, under reasonable conditions of security and reliability, may be validly used and produced as proof of the performance of the Contract, and more generally of any event relating to the conclusion, performance or termination of the Contract. “Ek Takay Shikkha” may validly produce in any proceedings, for the purpose of proving any act, fact, or omission, the data, files, programs, recordings, or other elements received, issued, or stored by means of the aforementioned computer systems, on any digital or analogical media, and rely on them, except in the case of an obvious error.

  • Article 10 - Amendments to the T&Cs
  • These T&Cs may be amended by “Ek Takay Shikkha” at any time. The amended T&Cs will come into force as soon as they are published online. In the case that “Ek Takay Shikkha” modifies the T&Cs, an email may be sent to Members notifying them of the change before the modified T&Cs are posted online. Any Member so informed has the right to accept or reject the proposed changes by maintaining his or her activated account or by unsubscribing. Members acknowledge and accept that silence maintained following receipt of this email is deemed to be acceptance of the amendment to the Contract.

  • Article 13 - Severability of clauses
  • In case one of the T&C’s clauses is considered, in whole or in part, to be null, void, unlawful, or unenforceable for any reason whatsoever, this shall not affect the validity or effectiveness of the other clauses of the Contract.

  • Article 14 - Applicable law
  • The Contract is governed by the Societies Registration Act, 1860.
